1. The WITM Platform Role
Work In The Mitten (WITM) operates as a media-first talent platform and technological intermediary. We are not an employer, joint employer, or a traditional personnel agency. We provide a digital infrastructure designed to showcase Michigan's premier company cultures and facilitate high-vibe connections between talent and industry. Your use of the platform constitutes a binding contractual agreement to these Terms.
2. No Guarantee of Employment
Participation in the WITM Talent Collective, submission of a profile via the /join page, or engagement with our media content does not guarantee interviews, placements, or any specific employment outcome. WITM provides the stage; the performance and the final hiring decision remain exclusively between the candidate and the third-party employer.
3. Third-Party Liability & FCRA Disclaimer
WITM is NOT a Consumer Reporting Agency (CRA) as defined by the Fair Credit Reporting Act (FCRA). Any candidate matching, sorting, or profile metrics provided are for informational and networking purposes only and do not constitute a 'consumer report.' Employers are solely responsible for conducting their own independent, FCRA-compliant vetting and background checks. WITM disclaims all liability for the actions, workplace safety, or hiring practices of third-party employers.
4. The Mitten Bounty (Referral Program)
Our referral program is a discretionary promotional initiative. Referrers operate strictly as independent contractors. Bounties are triggered only upon a referred candidate's successful placement and completion of a contiguous 90-day probationary period. In accordance with the One Big Beautiful Bill Act (OBBBA), WITM will require a Form W-9 and issue a Form 1099-NEC only if aggregate annual earnings reach or exceed the $2,000 statutory reporting threshold. You are solely responsible for your own tax obligations.
5. Michigan Regulatory Compliance
WITM is a free technological service for all talent candidates. We do not charge registration fees or extract valuable consideration from job seekers, ensuring compliance with the Michigan Personnel Agency Act during its current transition toward full legislative deregulation under House Bill 4933.
6. User Integrity & Intellectual Property
Accuracy is the baseline. Providing fabricated work history or false LinkedIn data results in immediate, permanent removal from the network. All 'Varsity Editorial' styling, Osmo-produced media, and platform architecture are the exclusive intellectual property of WITM. Unauthorized scraping or repurposing of our talent data is strictly prohibited.
